Supreme court fines Montana for using Tivoli in chair name

The furniture manufacturer was found to have violated Tivoli’s trademark

The Supreme Court ruled on Friday last week that the furniture manufacturer Montana has to pay two million kroner plus interest to Tivoli for violating the theme park’s trademark by naming one of its products the Tivoli chair, Jyllands-Posten reports.

The parties have been in dispute for several years and the case initially went to the Maritime and Commercial High Court. The court’s ruling there in favour of Tivoli was appealed, giving rise to Friday’s verdict.

The chair in question is a reproduction of a design from the 1950s by Verner Panton. The original chair was designed for a restaurant in Tivoli and became known as the Tivoli chair. However, when Montana reintroduced it to the market in 2004, Tivoli wanted payment to use the name and Montana refused.
